1. Introduction

These Terms of Service govern the use of the LinkedIn for Workflows platform (“Service”). The Service is owned and operated by Think Three Pty Ltd (“we”, “us”, “our”). By accessing, installing, or using the Service, you agree to be bound by these Terms. If you use the Service on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms. If you do not agree, you must not use the Service.

For clarity, Think Three Pty Ltd acts as a data controller for account-level information and a data processor for workflow-triggered LinkedIn data, in accordance with applicable privacy laws.

2. Definitions

For purposes of these Terms:

“Service” refers to the LinkedIn for Workflows application, including all related features, integrations, documentation, and functionality.

“User”, “you”, or “your” refers to the individual or organisation using the Service.

“Account Data” refers to information provided during registration or configuration, including agency details, contact information, and CRM identifiers.

“Workflow Data” refers to data processed through user-created automations, including LinkedIn message content, activity logs, and CRM-triggered actions.

“Third-Party Platforms” refers to LinkedIn, Unipile, Lead Connector CRM, ElevenLabs, cloud hosting providers, and other integrated systems.

3. Description of the Service

LinkedIn for Workflows connects Lead Connector CRM with the Unipile API to enable user-initiated LinkedIn automations, including messaging, connection requests, activity monitoring, profile engagement, two-way chat, and workflow-triggered actions. All interactions with LinkedIn occur only when initiated or configured by the user within Lead Connector CRM.

The Service is intended for authentic professional engagement. It must not be used for mass scraping, spam, unsolicited messaging, harvesting of data, or any conduct that violates LinkedIn’s Terms of Service or professional community standards.

The Service is provided on an “as is” and “as available” basis.

4. Account Eligibility and Requirements

To use the Service, you must maintain:

  • a valid LinkedIn account in good standing, and
  • valid authentication through Unipile.

You must secure all CRM credentials, integration tokens, and authentication data. You are responsible for all actions executed through your account, including automated workflows.

We may suspend or terminate your access if we detect suspicious, abusive, or non-compliant activity.

5. Use of LinkedIn and Third-Party Platforms

Your use of the Service must comply with all LinkedIn policies, terms, rate limits, and professional guidelines. You acknowledge that LinkedIn may detect or restrict automated activity, even when configured responsibly.

We do not store LinkedIn login credentials. Authentication occurs via Unipile, which securely facilitates LinkedIn interactions. We process Workflow Data solely according to your CRM workflow configurations.

We do not control LinkedIn, Unipile, Lead Connector CRM, ElevenLabs, or any other Third-Party Platform and are not responsible for their behaviour, uptime, availability, limitations, or policy enforcement.

Delays, errors, or limits imposed by Third-Party Platforms may affect workflow execution.

6. Prohibited Activities

You may not use the Service to:

  • violate LinkedIn’s Terms of Service or rate limits
  • scrape, harvest, export, or mass-collect LinkedIn data
  • engage in spamming, harassment, or inappropriate outreach
  • attempt to circumvent LinkedIn’s restrictions or automation safeguards
  • use fake, duplicate, or misleading LinkedIn accounts
  • reverse engineer, decompile, disassemble, or derive source code
  • copy features, workflows, or functionality
  • build, train, or support a competing product
  • use the Service for benchmarking or competitive analysis

Violation of this section may result in immediate suspension or termination without notice.

7. Subscription, Billing, Refunds, and Cancellations

The Service is available through monthly or annual subscriptions. All billing, payments, renewals, cancellations, adjustments, and refunds are handled exclusively by Lead Connector CRM.

We do not process payments directly and cannot issue refunds.

All purchases are final. No refunds are provided under any circumstances, including:

  • partial billing periods
  • LinkedIn account restrictions or bans
  • changes to LinkedIn or Unipile API behaviour
  • discontinued features or service updates

You must cancel your subscription through Lead Connector CRM. Cancellation stops future billing but does not affect prior charges.

8. Limited White-Label and Resale Rights

Agencies may resell or mark up the Service within Lead Connector CRM and may apply agency branding within the CRM interface. These rights are limited and do not imply transfer of ownership or expanded licensing rights.

You may not:

  • resell the Service as a standalone product
  • modify or obscure copyright notices
  • sublicense or redistribute the Service outside Lead Connector CRM
  • imply ownership or authorship of the Service or underlying technology
  • continue to use or redistribute branding rights after termination

All intellectual property remains the exclusive property of Think Three Pty Ltd.

9. Intellectual Property Rights

All software, code, workflows, documentation, features, design, and intellectual property associated with the Service are owned exclusively by Think Three Pty Ltd.

You are granted a limited, revocable, non-transferable license to use the Service for your internal business purposes only, subject to these Terms.

Reverse engineering, decompiling, copying, or creating derivative works is strictly prohibited.

These restrictions survive termination.

10. Service Availability and Modifications

The Service may be unavailable due to maintenance, updates, third-party outages, API limitations, or factors outside our control. We do not guarantee continuous uptime, error-free operation, or uninterrupted access.

We may modify, enhance, suspend, or discontinue features at any time. Continued use of the Service after modifications constitutes acceptance of the updated features.

Support is available via email and CRM ticketing during business hours (Monday–Friday, 24 hours).

11. No Liability for LinkedIn Account Restrictions

You acknowledge that:

  • LinkedIn may restrict, flag, or ban accounts based on behaviour patterns
  • LinkedIn alone determines compliance with its policies
  • LinkedIn may change or enforce limits without notice
  • API behaviour is controlled by Third-Party Platforms, not us

We bear no liability for:

  • LinkedIn account bans or restrictions
  • API errors or interruptions
  • changes to rate limits or platform rules
  • failed workflows caused by LinkedIn, Unipile, ElevenLabs, or Lead Connector CRM

All risks associated with LinkedIn usage remain solely with the user.

12. Disclaimers of Warranties

To the fullest extent permitted by law, the Service is provided “as is” and without warranties of any kind. We disclaim all warranties regarding accuracy, reliability, performance, integrations, data handling, merchantability, fitness for purpose, and non-infringement.

You acknowledge that automation carries inherent risks and that results may vary based on third-party behaviour.

13. Limitation of Liability

To the fullest extent permitted by law:

  • we are not liable for any indirect, incidental, special, punitive, or consequential damages
  • we are not liable for lost profits, data loss, reputational harm, business interruption, or third-party platform penalties
  • our total cumulative liability is limited to the lesser of AUD $100 or the fees you paid in the preceding twelve (12) months

These limitations apply regardless of the legal theory and survive termination.

14. Indemnification

You agree to indemnify, defend, and hold harmless Think Three Pty Ltd from any claims, damages, losses, liabilities, penalties, or expenses arising from:

  • misuse of the Service
  • violation of LinkedIn’s Terms or policies
  • automation behaviours leading to account restrictions
  • breach of these Terms
  • your agency resale or branding activities
  • your processing of LinkedIn data or personal data
  • third-party platform interactions triggered by your workflows

15. User Warranties

You warrant that:

  • you have lawful rights to all data processed through your workflows
  • you will comply with all applicable laws, including privacy and anti-spam legislation
  • your use of the Service will follow LinkedIn’s Terms, policies, and community standards

16. Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control, including failures of LinkedIn, Unipile, Lead Connector CRM, internet outages, cloud provider disruptions, system failures, natural events, or governmental actions.

17. Termination and Suspension

We may suspend or terminate access to the Service at our discretion if:

  • these Terms are violated
  • LinkedIn’s Terms are violated
  • suspicious, unsafe, or abusive behaviour is detected
  • authentication tokens become invalid
  • your use poses a security or compliance risk

Upon termination, your licence to the Service ends immediately.

18. Governing Law and Dispute Resolution

These Terms are governed by the laws of Queensland, Australia. Any disputes arising out of or relating to the Service will be resolved exclusively in the courts of Queensland. You consent to the jurisdiction of these courts.

19. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

20. No Waiver

Our failure to enforce any provision does not constitute a waiver of that provision or any other rights under these Terms.

21. Survival

Sections relating to intellectual property, prohibited activities, disclaimers, indemnification, and limitation of liability survive termination.

22. Entire Agreement

These Terms constitute the entire agreement between you and Think Three Pty Ltd regarding the Service and supersede all prior or contemporaneous agreements, communications, and understandings.

23. Changes to the Terms

We may update these Terms at any time. Changes will be communicated through the CRM or within the platform. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
